Terms of Use

1. Acceptance

By accessing or using SpokeWatch ("the Service") you agree to these Terms of Use. If you do not agree, please do not use the Service. The Service is a community research prototype focused on bicycle theft awareness in Adelaide, South Australia, and is not affiliated with South Australia Police or any government agency.

2. Eligibility & accounts

You must be at least 13 years old to use the Service and at least 16 to create an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly of any unauthorised access.

3. Acceptable use

You agree not to:

• Submit reports you know to be false, misleading or fabricated.
• Identify, harass, defame or threaten any individual, including suspected offenders.
• Post personal information about other people (addresses, phone numbers, vehicle plates, photos of bystanders).
• Use the Service to coordinate vigilante action, confrontation or retaliation.
• Scrape, bulk-download, resell or commercially redistribute data from the Service without prior written permission.
• Attempt to disrupt, probe or circumvent the security or integrity of the Service.

We may remove content and suspend accounts that breach these rules, with or without notice.

4. Your content

You retain ownership of the reports, descriptions and photos you submit ("Your Content"). By submitting Your Content you grant SpokeWatch a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt (e.g. for de-identification and mapping) and distribute it for the purpose of operating the Service, producing aggregated insights and supporting community safety research. You confirm you have the right to grant this licence and that Your Content does not infringe anyone else's rights.

5. Reports about your own bike

"Claim this listing as the owner" and similar actions are intended for the lawful owner or someone acting with their explicit authority. Do not claim bikes that are not yours. False claims may be removed and the associated account suspended.

6. No reliance & no legal advice

Information on the Service is community-submitted, may be incomplete or inaccurate, and is provided for general awareness only. It is not a substitute for reporting theft to police, contacting your insurer or seeking legal advice. Always file an official police report for actual theft incidents.

7. Intellectual property

The SpokeWatch name, branding, design, original written content and underlying code are owned by the project operator. Public display of aggregated incident data may be referenced or quoted for journalistic, research or community-safety purposes with clear attribution to "SpokeWatch". Bulk reuse, commercial redistribution or republication of derived datasets requires prior written permission.

8. Third-party services & links

The Service uses third-party infrastructure (such as hosting, authentication and mapping providers) and may link to external sites. We are not responsible for the content, policies or practices of third parties.

9. Availability & changes

The Service is provided on an "as is" and "as available" basis. We may add, change or remove features, suspend the Service for maintenance, or discontinue the project at any time without notice.

10. Disclaimers & liability

To the maximum extent permitted by law, SpokeWatch and its operators disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or property (including bicycles) arising out of your use of, or inability to use, the Service. Nothing in these Terms excludes rights that cannot be lawfully excluded under the Australian Consumer Law.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access where we believe these Terms have been breached or where required by law. Sections relating to content licensing, disclaimers and liability survive termination.

12. Governing law

These Terms are governed by the laws of South Australia, Australia. You agree to the non-exclusive jurisdiction of the courts of South Australia for any dispute arising from your use of the Service.
